Spill Privacy Policy

This Privacy Policy explains how Spill App, Inc., a Delaware corporation ("Spill," "we," "us," or "our"), collects, uses, and shares information in connection with thespillapp.com, the Spill app, the waitlist, and the Spill Ambassador Program (collectively, the "Services").
1. Information We Collect
Information you provide. When you join the waitlist, the app, or the Ambassador Program, we collect:
- Name
- Email address
- College/university (if applicable)
For Ambassadors who win prizes, we may additionally collect information needed to deliver prizes and meet legal obligations, such as a mailing address and tax information (for example, a Form W-9).
Information collected automatically. When you use the Services or click a referral link or scan a QR code, we and our service providers may collect usage and device data such as IP address, device/browser type, referral source, and the referral link/QR code used, including through cookies and similar technologies.
Referral data. For Ambassadors, we record sign-ups and downloads attributed to your unique referral link/QR code to operate the leaderboard, dashboard, and competition.
2. How We Use Information
We use information to:
- Operate the waitlist, app, and Ambassador Program;
- Track referrals and run the leaderboard, dashboards, and competition;
- Communicate with you (including about your account, the Program, and prizes);
- Award and deliver prizes and meet related tax/reporting obligations;
- Maintain security, prevent fraud, and enforce our terms; and
- Comply with legal obligations.
3. How We Share Information
We do not sell your personal information. We may share information with:
- Service providers that help us run the Services — for example, hosting and database providers (such as Supabase), email-delivery providers, and analytics providers — under appropriate confidentiality and data-protection terms;
- Authorities or others when required by law or to protect rights, safety, and the integrity of the Services; and
- A successor in connection with a merger, acquisition, or sale of assets.
4. Cookies and Tracking
We use cookies, local storage, and similar technologies to operate the Services, remember preferences, measure usage, and attribute referrals (for example, remembering which referral code brought you to us). You can control cookies through your browser settings.
5. Data Retention
We keep personal information for as long as needed to provide the Services and for legitimate business or legal purposes (for example, retaining prize and tax records as required by law), and then delete or de-identify it.
6. Security
We use reasonable administrative, technical, and physical safeguards to protect personal information. No system is perfectly secure, and we cannot guarantee absolute security.
7. Your Choices and Rights
You may update your information or ask us to delete it by contacting hello@thespillapp.com. Depending on where you live, you may have rights to access, correct, delete, or limit certain uses of your personal information.
California residents. If you are a California resident, you may have rights under the California Consumer Privacy Act (as amended), including the rights to know what personal information we collect and how we use and disclose it, to request access to or deletion of your personal information, to correct inaccurate personal information, and to not be discriminated against for exercising these rights. We do not sell your personal information or share it for cross-context behavioral advertising. To make a request, email hello@thespillapp.com; we will verify your request before responding.
8. Children's Privacy
The Ambassador Program is intended for individuals 18 and older. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact us at hello@thespillapp.com and we will delete it.
9. Changes to This Policy
We may update this Privacy Policy. We will post the updated version with a new effective date, and where required we will provide additional notice.
